EL CAMBIO DE GÉNERO NECESITARÍA TESTIGOS

Alejandra Pivaque, transfemenina, fue una de las primeras en apoyar y celebrar la opción de cambiar el sexo por el género en su cédula de identidad. Hace unos días la noticia del veto por parte del Ejecutivo a la Ley Orgánica del Servicio Nacional de Gestión de la Identidad y Datos Civiles la llenó de preocupación.

El vicepresidente de la Comisión de Gobiernos Autónomos, Descentralización, Competencias y Organización Territorial, Fausto Terán, aseguró que el Ejecutivo no ha vetado  los beneficios que pedían los transexuales, como el cambio de género en lugar de sexo.  Explicó que se trata de un veto parcial, el cual consiste en objeciones a solo 11 artículos del proyecto.

Uno de ellos es en el artículo 94, el cual estipula que las personas cuando cumplan 18 años de edad por una sola vez  pueden sustituir la palabra sexo por género, es decir cómo se siente e identifica. “Ante esto, el Ejecutivo ha incorporado que sean 2 testigos que ratifiquen este hecho, como un acto de prueba, como ocurre en el matrimonio, que para casarse le piden llevar dos personas”.

Para Pivaque, este nuevo paso de llevar 2 testigos sería una traba,  “porque  las únicas personas que podemos dar fe de nuestra identidad  y cómo nos sentimos somos nosotras”.

Ella reconoce que la ley es parte de un proceso en construcción y que a su vez implica una lucha aún por ganar.

Por su parte, Giovanny Jaramillo, vocero de la Federación Nacional GLBTI y transmasculino, no ve el cambio como una limitación sino como una puerta abierta para seguir trabajando.  “No quisiera que exista el tema de los testigos, pero si se lo compara con otros países es mínimo. En Colombia o en Argentina, para que se cambie el sexo, un transexual debe haberse sometido a un tratamiento médico y psicológico de al menos dos años”.

Elizabeth Vázquez, asesora legal de Pacto Trans, aseguró que la agrupación espera que no se impongan los testigos, por varias razones. “La tendencia en el mundo entero es eliminar requisitos, porque las imposiciones que coartan la autodeterminación de las personas son una especie de afirmación de que ellas no son capaces”.

El lunes la Comisión de Gobiernos Autónomos en la Asamblea analizó el veto parcial y en el tema de los testigos aún no hubo consenso. Mientras que el presidente Rafael Correa, a través de Twitter, negó que los cambios propuestos sean discriminatorios.

El vicepresidente de la Comisión desmiente además que se eliminaría el juicio de cambio de sexo, vigente desde 1976, a través de una sentencia judicial. En esta modalidad se establece que es posible la  rectificación en la partida de nacimiento si se cambia el sexo inscrito.

¿Cuáles son las otras objeciones?

Según Terán, en el artículo 52 que se refiere al matrimonio, la objeción del Ejecutivo contempla que se recoja textualmente lo que está en la Constitución, es decir que el matrimonio es la unión entre un hombre y  una mujer. “No lo habíamos puesto porque se sobreentendía, pero por algunas organizaciones que han salido a tergiversar, la ley es necesaria”.

Agrega que él mismo ha visto cómo en los exteriores de las iglesias recogen  firmas para evitar el matrimonio entre personas del mismo sexo. “Comienzan a desfigurar la ley, por eso el Ejecutivo ha creído conveniente que los artículos sean más claros”.

Adelanta que todas las objeciones serán analizadas esta semana por la Comisión y que este jueves deberá presentar un informe ante la Asamblea. El reporte, según el funcionario, podrá contener el allanamiento total de los articulados, de algunos o la ratificación de éstos.

Posteriormente la Asamblea tendrá 30 días para tomar una determinación de allanarse a lo que propone el Ejecutivo o la ratificación de la ley.

Las agrupaciones están a la espera de lo que pasará con la ley.  Según Jaramillo, este gobierno ha dado una mayor apertura a los grupos GLBTI que otros.  El activista indicó que este viernes estaría prevista una nueva reunión entre el presidente Correa y la comunidad diversa para exponer sus inquietudes al veto. Luego de permanecer archivada la ley que reconocía la inscripción del género en la cédula en 2015, una de las comisiones retomó su debate en la Asamblea.

Otra de las reformas de parte del Ejecutivo  como parte del veto parcial es mantener el nombre de Dirección General del Registro Civil y también el del documento como cédula de identidad y no DNI.

La Federación Nacional de GLBTI que surgió en 2015 reúne a 60 organizaciones de la comunidad trans. Entre una de las acciones más inmediatas es la creación de la plataforma Revolución Trans.

El proyecto de ley de Identidad contempla 98 artículos que han sido debatidos por los miembros de la Comisión de Gobiernos Autónomos, Descentralización, Competencias y Organización Territorial.

La Asamblea tendrá 30 días para tomar una decisión: allanarse al veto del Ejecutivo o ratificar la ley.
